These terms and conditions, hereinafter called (the “T&C”) apply to and govern your use of the Zeptagram trading app & website (the “App & services”). Additional terms and conditions are applicable if you register to any of the services that include, but are not limited to, sell or buy on the trading app Zeptagram hereinafter called (the “App & services”).
In these T&C Zeptagram is referred to as “Zeptagram”, “we” or “us” and Zeptagram refers to you as “You”.
When visiting our app & services, you are accepting to be bound by these T&C and our privacy policy, hereinafter called (the “Privacy Policy”) is also incorporated into and a part of these T&C. If you do not agree to the T&C and the Privacy Policy, do not use the app & services, request or register for any Services that Zeptagram from time to time offers.
Zeptagram reserve the right to modify and amend these T&C from time to time without notice. Changes are effective when posted and your continued use of our app & services or any Service following the posting of changes to these Terms will mean that you accept those changes.
This website along with the app & services is intended for people over the age of 18.
1. License to use the Website, the App & Services
All rights not expressly granted herein are reserved to Zeptagram.
You are hereby granted with a non-exclusive, non-transferable, limited right to access, use, and display the Website, App & services and materials, hereinafter called (the “Content”) on the Website, App & services for your personal informational use only, subject that you comply fully with these T&C. You may not modify, create derivative works from, participate in the transfer or sale of, post on the web, or in any way exploit the Website, App & services or any part thereof for any public or commercial use without the express written permission from Zeptagram.
You are allowed to download one copy of Content from the Site and Services for your personal informational use only, provided that you maintain all copyright, attribution and other notices contained in such Content, including without limitation trademarks of Zeptagram and the affiliated partners or the copyright holder identified in the individual content’s copyright notice.
You are not allowed to distribute, transmit, translated into any language, publish, rewrite, reproduce, create derivative works from, transfer, or sell any Content contained on this Site or Services without the express prior consent of the copyright owner without the prior written consent of Zeptagram. Any images included in the Website or in the App & services are provided for use only in the context of the Website, App & services and subject to all of the limitations set forth herein.
You shall not interfere or attempt to interfere with the operation of the website, App & services including, but not limited to, spamming, hacking, uploading computer viruses or spyware.
2. Ownership of the Content, Website, App & services
The Content at the Website, App & services are protected by the Swedish and international intellectual property laws including, without limitation, copyright, trademark, trade secrets, moral rights, rights of privacy, and rights of publicity (“Intellectual Property Rights”).
You acknowledge that you do not have or will acquire any ownership rights by your permitted use of the Website, its Content or any Services (app & services). You are responsible for complying with all applicable laws, rules and regulations regarding your use of any Content. In the event of any permitted copying, redistribution or publication of Content from the Website and Services (App & services), no changes in or deletion of author attribution, trademark, legend or copyright notice shall be made.
3. Termination or Change to Site or Services (app & services)
By accepting these T&C you have accepted that Zeptagram has the right in its sole discretion, to terminate, change, suspend or discontinue, temporarily or permanently, any aspect of the Website or App & services, without notice to you. Further you agree that Zeptagram may terminate your use of the Website, App & services, if Zeptagram believes that you have violated or breached these T&C or any third party. You agree that Zeptagram will not be held liable to you or any third party as a result thereof.
4. Third Party Content and Websites
As further explained below, some of the Content on the Website, App & services is owned and contributed by third parties. Such content does not necessarily represent the views or opinions of Zeptagram and Zeptagram is not responsible for third-party Content and the reliance upon Content posted on the Website or the App & services by third parties is at your own risk.
5.No responsibility for material transmitted by You
You accept that communications that are transmitted to Zeptagram by You to and from this Website and App & services are not confidential, and you are aware that your communications may be read or intercepted by others.
6.Claims of Infringement
Zeptagram respects the intellectual property of others and requires that you as a user do the same. If you believe that your content has been copied in a way that constitutes copyright infringement, please provide Zeptagram with a notice of infringement that includes at least the following information:
•Specify the copyrighted work that you claim has been infringed.
•Specify the material or link you claim is infringing and provide a description of where the infringing work is located on the Website, App & services.
•Provide your contact information including e-mail address, telephone number and, mailing address.
•You must also include a statement that the notice of infringement is correct and that you under penalty of perjury are the rightful owner or authorized to act on behalf of the rightful owner.

If you materially misrepresent that content or activity is infringing you may be liable for damages. If you are uncertain whether material infringes your copyrights (including whether use of copyrighted material may constitute fair use) you may wish to seek the advice of an attorney.
7.Monitoring, disclosing and removal of material transmitted by You
You agree that Zeptagram has the right, but not the obligation, to monitor your communications on the Website, App & services at any time for any reason, in its sole discretion to determine compliance with these T&C and other policies or guidelines that Zeptagram may establish. Zeptagram reserves the right at all times to edit, disclose, refuse to post, request removal of, or remove any Communication, in whole or in part, in its sole discretion, including, without limitation, as may be necessary to comply with any law, regulation, government or agency request or if Zeptagram in their sole discretion thinks that any material are objectionable or in violation of these T&C.
8.Limitation of Liability and Indemnity
You agree to indemnify and hold Zeptagram, their officers, directors, employees, agents, shareholders, licensors, suppliers, and any third party distributors harmless from and against any and all damages, losses, costs including attorney fees and expenses resulting from any violation by you as a user of these T&C.
9. Disclaimer of warranties
Zeptagram does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information displayed or distributed through the Website, App & services. You acknowledge that any reliance upon any such opinion, advice, statement or information shall be at your sole risk. Zeptagram reserves the right, in its sole discretion, to correct any errors or omissions in any portion of the Website, App & services.
You also acknowledge that the Website, App & services shall, the Services, including all Content, software, functions, materials and all information is provided on “AS IS” and “WITH ALL IT'S FAULTS” basis. There can be errors, bugs, system failure and/or Internet failure on events out of control by Zeptagram. Neither Zeptagram, nor it’s third party Content providers warrant that the functions, features or content contained in the site or services will be uninterrupted, accurate or error free, that defects will be corrected, or that any other site or the server that makes it available is free of viruses or other harmful components. If your use of this site or services results in the need for servicing or replacing property, material, equipment or data, Zeptagram is not responsible for those costs. If you are dissatisfied with the site or any services, your sole and exclusive remedy is to discontinue using the Website and/or the App & services.
10. Limitation of Liability; Exclusion of Damages
Zeptagram is not liable for any lost data resulting from the operation of the Website, App & services provision of the Services and/or the enforcement of the T&C. We urge all users to maintain their own backup versions of any communications they provide for submission to the Website, App & services. Zeptagram disclaims any and all liability for the acts, omissions and conduct of all users, advertisers and/or sponsors on the Website, App & services or otherwise related to your use of the Website and/or App & services. Zeptagram is not responsible for the products, services, actions or failure to act of any other third party in connection with the Website or the App & services.
UNDER NO CIRCUMSTANCES SHALL ZEPTAGRAM, IT’S SUBSIDIARIES, AFFILIATES OR THEIR LICENSORS, EMPLOYEES, OFFICERS OR DIRECTORS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES THAT ARE INDIRECTLY OR DIRECTLY RELATED TO THESE T&C THE CONTENT, THE WEBSITE OR THE APP & SERVICES, INCLUDING WITHOUT LIMITATION ANY LOSS OF REVENUE OR ANTICIPATED PROFITS OR LOST BUSINESS, EVEN IF SUCH ENTITIES OR AN UNAUTHORIZED REPRESENTATIVE THEREOF HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE TOTAL LIABILITY OF ZEPTAGRAM, ITS SUBSIDIARIES AND AFFILIATES TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR OTHERWISE) ARISING FROM THESE T&C OR YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY SERVICES EXCEED, IN THE AGGREGATE, SEK100 (One hundred Swedish Kronor).
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
11.Force Majeure
If Zeptagram is affected by Force Majeure it shall promptly notify You of the nature and extent thereof. Zeptagram shall not be deemed to be in breach of these T&C or otherwise be liable to You for any delay in performance or non-performance of any of its obligations hereunder to the extent that such delay or non-performance is due to any force majeure of which it has notified You and the time for performance of that obligation shall be extended accordingly.
12.User Information
All information we collect on this Website and/ or the App & services is subject to our Privacy Policy. By using the Website, App & services You consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.
13.Governing Law
These T&C shall be governed by the extensive laws of Sweden.
14. Survival
The provisions in articles 2-5 and 7-15 will survive termination of this agreement, together with all other T&C that by their nature or context are intended to survive termination.
15. Miscellaneous
These terms and conditions of use constitute the entire agreement between You and Zeptagram with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. No term or condition of these T&C shall be held to be waived, modified or deleted except by a written instrument signed by the parties hereto.
No delay or omission by any parties in exercising any right under these T&C shall operate as a waiver of that or any other right. A waiver or consent given by the other party on any one occasion shall be effective only in that instance and shall not be construed as a bar or waiver of any right on any other occasion.
The headings of the sections of these T&C are for convenience of reference only and in no way define, limit or affect the scope or substance of any section of these T&C.
In the event that any provision of these T&C shall be invalid, illegal or otherwise unenforceable, the validity, legality and enforceability of the remaining provisions shall in no way be affected or impaired thereby.
Nothing in these T&C provides You with the right, license, authorization or approval to make binding agreements with any person or entity on behalf of Zeptagram.
Any cause of action you may have with respect to Zeptagram must be commenced within one year after the claim or cause of action arises or such claim or cause of action is barred.
